Abstract

This paper describes the application of the doctrine of jurisprudential caution according to Ḥanafī jurists. It shows that when they adopted it in the chapter of fasting and I'tikāf, so other jurists left it in the same chapter. Therefore, there is a need to search for the other jurist’s arguments against it in these applications. So this paper mentions the other jurist’s opinions in the same applications with their arguments against this doctrine. It also gives preference it over other arguments or others over it after comparison between them. So this thing will clarify the position of this doctrine in Islamic jurisprudence. Further, by studying this paper we will be able to use this doctrine in contemporary Islamic jurisprudential matters. It will also help us to give preference to it over other arguments or to give preference to others over it in contemporary Islamic jurisprudential matters.
