Abstract

All the laws of Islam are important. But the rules of Qisas and Diat are also important in the sense that peace and order are possible in the society. The punitive system of Islam is also important because it has neither extremism nor favoritism like other religious systems. Islam protects human life in every possible way, even the murder deprives the murderer of the deceased's Inheritance. So that no one can kill anyone in the lure of property. Thus, this system of Islam is based on high justice. But sometimes because of its ignorance, or because of the unilateral criticisms of some foreigners, the positive aspects and qualities of Islam are often overlooked. After that, man becomes confused about Islam. Therefore, it was necessary that the details of the criminal system of Islam, especially Diat, should be brought to society so that the reality of the objections raised by the opponents of Islam can be made clear. In this article, the entire incident related to Diat, especially the case of Wakhshi Baghban in the former state of Chitral to the final decision, is mentioned in detail and then a jurisprudential analysis is also presented.
